These Terms of Use govern the use of the website, client portal, case management software, messaging systems, document upload tools, and electronic communications provided by Binder and Watson Law Group (“Firm,” “we,” or “us”).

By using this website, submitting information, or communicating electronically with the Firm, you agree to these Terms.

1. Electronic Communication Consent

  • Electronic forms
  • Electronic signatures
  • Text messages when appropriate

Electronic communications may include confidential or privileged information.
You accept the risks associated with electronic communications, including interception, delays, delivery failures, and unauthorized access.

2. No Attorney-Client Relationship

Use of this website or Portal does not create an attorney-client relationship.
Representation begins only after:

  • A written representation agreement is signed, and
  • The Firm agrees to represent you.

Until representation begins:

  • The Firm has no duty to act on submitted information
  • Deadlines will not be monitored
  • Information may not be treated as confidential

Do not submit sensitive or time-sensitive information unless you are an established client.

3. No Emergency or Deadline Communications

Electronic communications are not monitored continuously.
You agree not to rely on:

  • Portal messages
  • Website forms
  • Email
  • Text messages

for urgent or deadline-sensitive matters.

For urgent matters, you must contact the Firm by telephone.
The Firm is not responsible for missed deadlines or damages caused by delayed or unread electronic communications.

4. Portal Use by Clients

The client portal and case management software are provided for convenience only.
The Firm may use electronic communications for:

  • Case updates
  • Document exchange
  • Requests for information
  • Routine communications

You agree that the Firm may rely on electronic communications as accurate unless notified otherwise.
You are responsible for:

  • Reviewing messages promptly
  • Maintaining accurate contact information
  • Checking your Portal regularly

Failure to review Portal communications does not excuse missed deadlines or required actions. The Firm has no obligation to review or respond to electronic communications within any specific time period.

5. Delivery of Documents

For established clients, documents and messages transmitted through:

  • The client portal
  • Case management software
  • Email

are considered delivered when sent.
The Firm is not responsible for failure to review communications.

6. Security and Access Responsibility

The Firm uses commercially reasonable security measures, but no electronic system is completely secure.
You agree:

  • To keep login credentials confidential
  • Not to share access with unauthorized persons
  • To notify the Firm of unauthorized access

You are responsible for activity under your account.
The Firm is not responsible for damages caused by unauthorized access resulting from shared credentials or unsecured devices.

7. Electronic Signatures

Electronic signatures and electronically accepted agreements are legally binding and have the same effect as handwritten signatures.

8. System Availability

Electronic systems may become unavailable due to:

  • Technical failures
  • Maintenance
  • Internet outages
  • Software issues

The Firm does not guarantee uninterrupted access.
The Firm is not liable for damages caused by system interruptions or technical failures.

9. Limitation of Liability

To the fullest extent permitted by law, the Firm is not liable for damages arising from:

  • Electronic communications
  • Transmission failures
  • Unauthorized access
  • Technical issues
  • Delayed responses

This limitation applies even if the Firm has been advised of possible damages.
